County of Los Angeles DEPARTMENT 17

MELODIE MOLINA vs. LOS ANGELES UNIFIED SCHOOL DISTRICT, et al. | Case No.: 25STCV07571 Hearing Date: August 14, 2026 | Defendant's motion to compel Plaintiff's mental examination is GRANTED. Plaintiff Melodie Molina (Plaintiff) filed suit against Los Angeles Unified School District (LAUSD), City of Los Angeles, County of Los Angeles, Los Angeles County Office of Education alleging negligent failure to supervise. On 7/29/2026, LAUSD moved to compel Plaintiff's mental examination. The motion is unopposed.

Discussion

LAUSD argues that Plaintiff should be ordered to appear for a psychiatric, mental, and written psychological examination conducted by Suzanne M. Dupee, M.D., a licensed psychiatrist, because she has "affirmatively placed her mental condition directly in controversy by alleging that, as a result of Defendants' alleged conduct, she has suffered and continues to suffer severe emotional distress, mental anguish, humiliation, embarrassment, psychological injury, and other emotional and mental damages, for which she has sought treatment and also for which she seeks recovery in this action." (Motion, 2: 5-9.) After review, the Court agrees that Plaintiff has placed her mental condition directly in controversy and the requested examination is reasonable in scope and manner. Based on the foregoing, Defendant's motion to compel Plaintiff's mental examination is granted. It is so ordered.
