Defendants Richard Kislingbury et al.’s (“Defendants”) Motion to Lift Bankruptcy Stay is CONTINUED to Thursday, 9/24/2026 at 2:30 p.m. in Dept. 512.

The moving papers on this Motion do no appear to have been properly served on plaintiff in pro per Marc Christiansen (“Plaintiff”). Pursuant to CCP § 1010.6(b) and (c), in pro per parties may not be served by email unless they have consented on the record to accept such service. The Court is unable to find any record that Plaintiff in pro per has agreed to accept service of papers in this action by email.

Therefore, Defendants must re-serve Plaintiff with the moving papers by a permissible method along with a revised Notice of Motion noticing the continued 9/24/2026 hearing date. The Court observes that Plaintiff has an attorney representing him in a limited capacity, but the present motion does not appear to be within the scope of the representation as listed in the relevant Notice of Limited Scope Representation filed on 2/23/2024.

CONTESTING TENTATIVE RULINGS
