Tentative Ruling

Notices:

Parties who wish to contest the tentative ruling below must: (1) request a hearing by calling the Department 8C Oral Argument Request Line at (916) 874-8380 no later than 4:00 p.m. on the Court day before the scheduled CMC, and (2) advise opposing counsel of the request. If a hearing is not requested by 4:00 p.m. on the Court day before the scheduled CMC, the tentative ruling shall become the final order of the Court.

If a hearing is requested, the Court assumes that all parties will appear remotely via Zoom unless the Court orders in-person attendance. The Department 8C Zoom Link is https://saccourt-cagov.zoomgov.com/j/16039062174 and the Zoom Meeting ID is 160 3906 2174. Case Management Conference is scheduled for 11/06/2026 at 09:00 AM in Department 8C at Tani G. Cantil-Sakauye Courthouse.

The Case Management Conference has been continued to allow time for the Motion for Leave to File First Amended Complaint.

New Case Management Statements shall be filed by all parties no later than 15 days prior to the hearing pursuant to Local Rule 2.51.

The Court sets this matter for an Order to Show Cause why sanctions should not be imposed for the following reason(s): • failure to file a Case Management Conference Statement (Local Rule 2.51) OSC re: monetary sanctions up to $250 against Plaintiff, Defendants Spare Time, Inc. and Spare Time Indoor Tennis Investors, LLC, and their counsel jointly/severally for failure to file a CMC statement as required by Local Rule 2.51. Plaintiff and Defendant(s) to file a CMC statement within the time frame specified in Local Rule 2.51 prior to the continued CMC date.

The Order to Show Cause Re: Sanctions is set for 11/06/2026 at 9:00 AM in Department 8C at Tani G. Cantil-Sakauye Courthouse.

Failure to comply or appear and show cause, if any you have, may result in the dismissal of the

action on the Court’s motion pursuant to one or more of the following: CCP 583.250, CCP 583.360, CCP 583.410, and/or CRC 3.1385(b).

Attorney/Party Compliance Statement(s) (Local Form CV\E-112) shall be filed not less than fifteen (15) days prior to the hearing pursuant to Local Rule 2.55(C). Failure to timely file a statement may result in the imposition of sanctions.

Submitting a Request for Dismissal for filing in response to this Notice may not result in the OSC hearing being taken off calendar. Please visit the Court’s Public Portal at https://prodportal-sacramento-ca.journaltech.com/public-portal/ to review the status of the OSC hearing. All noticed parties will be required to appear as ordered unless the OSC hearing status has been updated to ‘Vacated’.
