Plaintiffs failed to shift their initial burden regarding exemption from the Tenant Protection Act of 2019. Plaintiffs offer no evidence or contention that they occupy the premises, an express requirement of the exemption under Civil Code 1946.2(e)(5). Plaintiffs offer no evidence or contention that they gave the written notice required for exemption under Civil Code 1946.2(e)(8). The plain language of Civil Code 1946.2(e)(8)(B)(ii)(I), which relaxes the methods by which the required notice may be provided for a tenancy existing before July 1, 2020, does not excuse the owner from providing the required notice at all. =(501/CFH)
