- Defendant: Xiaoyin Qu
- Defendant: Run the World, Inc.
Ruling
Set for Law and Motion/Discovery Calendar on Friday, April 24, 2026, Line 6.
2 - Defendant Run the World, Inc.'s unopposed Motion to Compel Responses to Request for Documents, Set Two, Demand Inspection, Production of Documents is GRANTED IN PART AND DENIED IN PART. The discovery requests at issue appear reasonably calculated to lead to the discovery of admissible evidence. (See Code of Civil Procedure section 2017.010.)
The record demonstrates Plaintiff Xuan Jiang did not provide any responses to the RFPs. Cross-Complainant's failure to timely respond is not excused. No meet and confer requirement exists for motions to compel responses for requests for production of documents when no responses have been provided. (Code of Civil Procedure section 2031.300.)
Plaintiff Xuan Jiang shall serve verified, objection-free, substantive responses to Defendant Run the World, Inc.'s RFP, Set Two no later than 15 court days after notice of this order. The exception is RFP, Set Two no.
45. Defendant has failed to demonstrate that the court can order a party to sign a medical records release under section 2031.300. Even if it could, the court would not issue such an order on this record.
Defendant's request for an order that Plaintiff produce all responsive documents at the same time she responds to the RFP is denied. First, Defendant's did not move under section 2031.320, which, as the court understands it, is the statute that would authorize such an order. Second, the legislature clearly contemplates a two-step process following an RFP: the party to whom the RFP is served first serves responses then, after the responses are settled, serves the documents and requested materials. On this record, the court declines to issue an order compelling immediate production of the responsive documents.
Plaintiff Xuan Jiang shall pay $560 to Defendant Run the World, Inc. as sanctions, payment no later than 20 court days from notice of this order. (Code of Civil Procedure sections 2031.300(c).) To the extent Defendant seeks different or additional relief, the motion is denied.
Defendant must prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and email it to contestdept302tr@sftc.org prior to the time set for hearing.
