DEFENDANT KEVIN WHITE DEMURRER to Amended COMPLAINT is SUSTAINED with leave to amend within 5 days of notice of entry of order for Plaintiff to allege Defendant White's interest in or relationship to the premises such that Plaintiff can proceed against him pursuant to this action based on CCP 1161a.

As to Defendant White, the Second Amended Complaint alleges only that he is currently in possession of the premises. This is not a sufficient factual basis to support Plaintiff's cause of action against Defendant White. Plaintiff is granted leave to amend to include similar allegations as to any other defendants in this action as well. =(501/CFH)
