On February 27, 2026 the Court issued at tentative ruling requesting a supplemental brief addressing the propriety of service of the Petition pursuant to CCP 1011. No supplemental brief was filed providing authority or argument supporting the proposition that service of Petition to Compel Arbitration is appropriate pursuant to CCP 1011(a) (See original Proof of Service) or CCP 1011(b) (See Proof of Service attached to March 13, 2026 Declaration Regarding Service of Summons and Petition).
Pursuant to Ex. A to the Declaration Regarding Service of Summons and Petition the service was purportedly "made in the manner specifically provided in particular cases." There is no argument or evidence referenced anywhere in the March 13, 2026 supplemental filing as to "the manner specifically provided" in this case and that the service as described in Exs. 2A-2C to the Declaration Regarding Service of Summons and Petition satisfies the specific requirement, whatever it may be. =(501/CFH)
