Defendant's motion for judgment on the pleadings is off calendar.
"Before filing a motion for judgment on the pleadings pursuant to this chapter, the moving party shall meet and confer in person, by telephone, or by video conference." (CCP 439(a).) The moving party is also obliged to file a declaration setting forth the "means by which the moving party met and conferred." (CCP 439(a)(3)(A).) The moving party's declaration does not describe the means by which the parties met and conferred. (Gallagher Decl., par. 2 ["I attempted to communicate with Plaintiff's counsel regarding the deficiencies in the Complaint but the parties were unable to reach a resolution."]. Moreover, the record discloses that no meet and confer actually occurred. (Cohen Decl., pars. 3-5.)
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
