DEFENDANT XIU CHEN MOTION FOR SUMMARY JUDGMENT is GRANTED. It is undisputed that the subject premises is an illegal rental unit. Therefore, the rental agreement is void, and Plaintiff cannot prevail in this unlawful detainer action, which is based on nonpayment of rent. Prevailing party to prepare an order in compliance with CCP 437c(g). =(501/CFH)
