The Court is prepared to accept Mr. Kelly's declaration filed in response to the OSC and discharge the OSC. However, the Court has a great concern regarding Mr. Kelly's characterization of the issues raised in the OSC as mere "technical errors." These issues include (1) incorrect information in a declaration executed under the penalty of perjury regarding service, i.e. due process rights being implicated; (2) attempted ex-parte communication with the Court; and (3) repeated failure to comply with the Court processes, rules and directions.
The Court is also concerned with Mr. Kelly's apparent belief that this Order to Show Cause has any impact on the defendant's rights and not designed to address Mr. Kelly's actions in this case (See Kelly Declaration 5:7-19). To the contrary, it is counsel's actions that may adversely affect the client, not the Court's constant efforts to bring the issues to Mr. Kelly's attention with the intent that those issues are rectified immediately and are not repeated over and over again depriving the parties of their ability to be timely heard. The Court further notes that no courtesy copy of Kelly Declaration was received. =(501/CFH)
