DEFENDANT AUDILIO POLANCO DEMURRER to COMPLAINT is OVERRULED, 5 days to answer. Complaint states a cause of action for unlawful detainer under CCP 1161(4). Moving party failed to show that violation of SF Administrative Code 37.3(c)does not constitute illegal use or unlawful purpose; and is a mere ancillary legal violation unrelated to the functional purpose of the property.
