Petition To Confirm Arbitration Award And To Enter Judgment

Petitioner JMM filed this petition to confirm a contractual arbitration award. Petitioner represented Respondent 2700 Sloat Holdings, LLC in an action. In June 2025 and after hearing, the arbitrator awarded Petitioner $122,811.41. In December 2025, Petitioner filed this petition to confirm the award.
"A petition to confirm an award shall be served and filed not later than four years after the date of service of a signed copy of the award on the petitioner. A petition to vacate an award or to correct an award shall be served and filed not later than 100 days after the date of the service of a signed copy of the award on the petitioner." (Code of Civil Procedure section 1288.) "A response requesting that an award be vacated or that an award be corrected shall be served and filed not later than 100 days after the date of service of a signed copy of the award." (Code of Civil Procedure section 1288.2.) If a petition to confirm is duly served and filed, "the court shall confirm the award as made," unless the award is corrected or vacated, or the proceeding is dismissed. (Code of Civil Procedure section 1286.)
The record demonstrates Petitioners duly served and filed their petition. Respondent has not demonstrated grounds to correct or vacate the award or dismiss the proceeding. The arbitration award is confirmed, and judgment shall be entered consistent with the award. Petitioner shall submit a simple proposed judgment with an attachment that is the arbitration award. The current proposed judgment in which the award is referenced as an exhibit to the Neudecker declaration (but not attached to the judgment) and that contains extraneous text following the amount, is not workable. Prior to the hearing, Moving Party shall lodge by email to contestdept302tr@sftc.org a proposed order repeating the above verbatim.
