Defendants FCA US, LLC and Michael Stead's Auto Depot Hilltop Chrysler Dodge Jeep Ram's demurrer to the complaint is OFF CALENDAR. Defendants' demurrer challenges Plaintiff's initial complaint, but Plaintiff has now filed an amended complaint. Thus, the court orders the instant demurer, which challenges a superseded pleading, off calendar.
Plaintiff is admonished regarding his meet and confer duties. In connection with demurrers and motions to strike, The Legislature clearly imposed upon both parties a duty to make a reasonable and good faith effort through personal communication to resolve the issues regarding the cross-complaint. (See Code of Civil Procedure sections 430.41 and 435.5.) Not participating meaningfully is not an option and cannot be abided. Here, meaningful participation would have resulted in Plaintiff informing Defendants that he would be filing an amended complaint, sparing Defendants and the court from wasting resources on the demurrer and motion to strike.
Moving Parties are ordered to prepare a proposed order which repeats verbatim the above text and email it to contestdept302tr@sftc.org prior to the time set for this hearing.
