HEARING ON CLAIM OF EXEMPTION
Set for Law and Motion/Discovery Calendar on Wednesday, February 04, 2026, Line 11. PLAINTIFF VELOCITY INVESTMENTS, LLC HEARING ON CLAIM OF EXEMPTION.
Before the court is Defendant and Judgment Debtor Azucena Jimenez-Maldonado's claim of exemption to Plaintiff and Judgment Creditor Velocity Investments, LLC's levy on certain earnings. The hearing is continued to February 13, 2026 at 9 am in this department.
The levying officer purportedly is the Sacramento County Sheriff's Office ("SCSO"). Plaintiff and Judgment Creditor served Notice of Hearing on Claim of Exemption-noticing the hearing for 2/4/2026-on Defendant and Judgment Debtor by mail from out of state on 1/22/2026, from Chicago, Illinois. Where either the place of mailing or the place of address is outside the State of California but within the United States, the required notice period is increased by 10 calendar days. (See Code of Civil Procedure section 1005(b).) Plaintiff and Judgment Creditor's service effectively resulted in three days' notice for the hearing, which implicates due process.
Plaintiff and Judgment Creditor's manner of notice and notice of hearing may, too, be the root of the most practical obstacle to adjudication of the claim of exemption and opposition, which is the court is without Defendant and Judgment Debtor's claim of exemption (EJ-160) or their financial statement (EJ-165). It seems likely that SCSO has not had sufficient time to deliver these materials to the court. The court continues the hearing to allow for a greater notice period and to give SCSO sufficient time to deliver the necessary materials to the court.
Plaintiff and Judgment Creditor is ordered to prepare a proposed order which repeats verbatim the above text and email it to contestdept302tr@sftc.org prior to the time set for this hearing.
