Jon-Paul Moorehead and Law Offices of Richard W. Meier's Motion to be Relieved as Counsel for Plaintiff Paul Carey Jr. is GRANTED. Good cause appearing, the motion is granted.
Plaintiff's protest regarding inadequate service is without merit. On 12/17/2025, Estefani Marquez swore under penalty of perjury in a proper proof of service she served the motion, declaration and proposed order on Plaintiff by overnight mail. Plaintiff's 12/26/2025 Declaration he was never served is not, itself, accompanied by any proof of service. The court credit's Marquez's testimony. In any event, clear is the fact Plaintiff had actual notice of the motion no later than 12/21/2025, the date he prepared his "Formal. Opposition." If Plaintiff had not yet been served, he had plenty of time to follow up. Any failure to do so is on him.
No later than 8:30 am on 2/4/2025, Moving Party must lodge by email to contestdept302tr@sftc.org an updated proposed order on MC-053 with accurate information inserted, where appropriate. Note the Order will not be effective until Counsel files a Proof of Service of the executed order.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
