1 - Defendant Physical Intelligence, Inc.'s unopposed Motion to Admit Counsel Matthew D. Gorman Pro Hac Vice is DENIED WITHOUT PREJUDICE. Counsel Matthew D. Gorman has failed to declare '[t]he title of each court and cause in which the applicant has filed an application to appear as counsel pro hac vice in this state in the preceding two years, the date of each application, and whether or not it was granted." (See Cal. Rules of Court, rule 9.40(d)(5).) It is not sufficient for counsel to simply identify the number of cases in which PHV appearance has been authorized. (See Gorman Decl. para. 7.) The requirements are quite straightforward and set out clearly in the Rule of Court. Counsel requesting discretionary leave to appear in an action should take care to fulfill them.

Moving Party is ordered to prepare a proposed order which repeats the above text verbatim and email it to contestdept302tr@sftc.org prior to the time set for hearing.

The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.

The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
