Tentative Ruling:

To overrule without prejudice to arguing the same grounds in a subsequent motion.

Explanation:

The demurrer must be overruled because the motion was not served on the current address for plaintiff. The papers were served on plaintiff at the address listed on the Complaint. However, on March 26, 2025 plaintiff filed and served a notice of change of address. Because the motion was not served on plaintiff at her current address, she has no notice of the motion.

Pursuant to California Rules of Court, rule 3.1312(a), and Code of Civil Procedure section 1019.5, subdivision (a), no further written order is necessary. The minute order adopting this tentative ruling will serve as the order of the court and service by the clerk will constitute notice of the order.
