Request for Order – Child Support
This matter is before the Court on Respondent/Father’s April 20, 2026 Request for Order (RFO) for a modification of child support regarding the parties’ son, Jeremiah (DOB: 05/05/2008).
Father is seeking a post-judgment order. Per MCR Fam. Rule 7.8(F) "In all post-judgment proceedings, parties must submit an Address Verification Declaration for Post-Judgment Request for Order. For custody/visitation or child support, parties shall use FL-334 ... " and one is not on file. Additionally, there is no proof of service of the RFO on file.
Father’s RFO fails to comply with MCR Fam Rule 7.13, which provides "in all proceedings where child or spousal support ... are an issue, in addition to filing completed Income and Expense Declarations, each party is required to serve on the opposing party and lodge (under seal) copies of the party's two most recent state and federal income tax returns and W2s."
On June 2, 2026, Father's motion was continued to July 28, 2026, to serve Mother and to comply with Local Rules 7.8 and 7.13. There is still no proof of service on file and no compliance with Local Rule 7.13.
Father’s request for child support modification is denied without prejudice.
As authorized by CRC Rule 5.125, court will prepare the formal Findings and Order After Hearing.
