The Motion for Final Approval of Settlement filed by Isidro Miranda on 04/21/2026 is Granted in Part.
Plaintiffs Motion for Approval of Private Attorneys General Act Settlement is GRANTED, as follows.
The Court approves the parties proposed settlement, with the following modifications.
Each of the two named Plaintiffs shall receive a representative service award of $10,000 each (reduced from $20,000.)
The total attorneys fees awarded will be $1.1 million, allocated as follows: $715,000 to Mallison & Martinez, $192,500 to Zakay Law Group APLC, and $192,500 to JCL Law Firm APC.
Of those total attorney fee awards, the following amounts shall be payable as of the date the judgment is entered: $640,000 Mallison & Martinez, $170,000 to Zakay Law Group APLC, and $170,000 to JCL Law Firm APC. The remaining amounts of the attorney fee awards shall be retained by the settlement administrator pending the compliance hearing described below.
Based on the reduction in the representative service awards and the attorney fee awards, the amount of the remaining net settlement amount paid to the LWDA shall be $1,760,053.74, and the amount paid to the aggrieved employees shall be $586,684.58.
The Court schedules a compliance hearing for February 24, 2027 at 3:00 p.m. in Department 19. By no later than February 9, Plaintiffs counsel shall file a status report confirming that the LWDA has been paid the specified settlement amount, and indicating the amount of the settlement funds paid to the aggrieved employees and/or the cy pres beneficiary.
Plaintiffs are directed to submit a revised (proposed) Order and Judgment Granting Plaintiffs Motion for Approval of Private Attorneys General Act Settlement for the Courts signature, modified as indicated above.
Case Management Conference is scheduled for 02/24/2027 at 03:00 PM in Department 19 at Rene C. Davidson Courthouse.
