Ruling

In re: James Howard Lawler, Sr. and Betty Mae Lawler Living Trust, 25PR-0168

Hearing: Motion to Deem Requests for Admissions, Admitted Motion to Compel Responses to Form Interrogatories, Set One Motion to Compel Responses to Special Interrogatories, Set One Motion to Compel Responses to Requests for Production, Set One

Date: June 24, 2026

Service of the Notice of Hearing for these motions was provided on May 21, 2026. No responses have been filed. The motions are granted. Petitioner is to provide responses without objections to the form interrogatories, special interrogatories, and requests for production no later than July 8, 2026. The requests for admission are deemed admitted.

The Court reduces Respondent’s sanctions request by (a) one hour for each motion attributed to preparing a reply brief which was unnecessary; (b) one hour for the three motions to compel initial responses for appearing at the hearing. Only one appearance fee will be provided; and (c) .25 hour per motion as all four motions charged for the same March 2, 2026 meet and confer email which was one paragraph. The Court will not award an appearance fee for the hearing on May 20, 2026, because Respondent’s counsel failed to give proper notice of that hearing.

The Court awards the following sanctions against Petitioner and her attorneys of record: (a) $866.25 for the requests for admission motion (includes the one appearance fee) and (b) $577.50 for each of the other three motions. Total sanctions are $2,598.75.

ORDER

The motion to deem the requests for admission is granted. The motions to compel initial responses without objections to the first set for form interrogatories, special interrogatories, and requests for production are granted. The Court awards sanctions of $2,598.75 against Petitioner and her counsel of record.
