Absent objection, the Petition is granted. The Court appoints Rocque Merlo and Ana Maria Altube- Starr as the Special Administrators with the limited authority to continue and maintain the litigation Estate of Nolta, on behalf of the Decedent Madeleine U. Nolta with regards to Butte County Superior Court Case No. 9:00 26PR00130 Madeleine U 23PR00432, In re: The Conservatorship of Madeline U. Nolta, currently under appeal (Third District Court of Appeal No. C104360). Bond is not required. Counsel shall submit a new Order for Probate within two weeks.

The Court notes several deficiencies in the Petition to Determine Succession to Primary Residence, including (1) it is unclear whether the Petitioner is the spouse, fiancé, or registered domestic partner of the Decedent based on the inconsistencies in the Petition and various documents attached thereto; (2) There is no Attachment 11 with the legal description and the Assessor's Parcel Number of the real property; (3) the Decedent's Will identifies two children: Kayla Saise and Alfonso Saise III, however Estate of: Saise, it is not indicated at Paragraph 9.a.(5) that the Decedent was survived by a child, nor was notice 9:00 26PR00131 Alfonso, Jr provided to either of these individuals as required by Probate Code section 13151(b); (4) Petitioner has marked the incorrect box at Paragraph 15; and (5) the Will does not appear to include any dispositive provisions, so the Court concludes, based on what has been submitted, that there are insufficient facts upon which the Petitioner bases the allegation that the described property is property passing to the Petitioner (Probate Code section 13152(a)(4)). This matter is continued to June 30, 2026 at 9:00 a.m. for the filing of an Amended Petition and proper notice.

The petition is granted, letters of administration with full authority shall issue, bond is waived, Jane Dolan is appointed as probate referee and a final distribution hearing is set for May 18, 2027 at 9:00 Estate of James, 9:00 26PR00139 a.m. In the event the administrator is unable to file the petition for final distribution seven (7) days Paula Beth prior to the final distribution hearing, the administrator shall file a status update seven (7) days prior to the hearing. The Court will sign the form of order submitted by counsel.
