LUNA) 11) 12 REQUEST FOR ORDER OF REQUEST FOR ORDER RE CHILD CUSTODY-VISITATION- 13 SUPPORT CHILD CUSTODY, VISITATION (PARENTING TIME), CHILD SUPPORT 14 TENTATIVE RULING 15 Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the 16 Court makes the following findings and orders: 17 A.
Procedural History 18 1) The parties are Petitioner Bryan James Beeley (Father) and Respondent Katherine J. Carpenter 19 (Mother). They share two minor children: River Melody Beeley Carpenter (DOB; 08/21/17) and 20 Jade Forest Carpenter Beeley (DOB: 12/30/19). 21 2) On December 4, 2025, Father filed a Request for Order seeking orders related to child custody, 22 visitation, and child support. The matter was set for hearing on January 12, 2026. Father requests: 23 a. Joint legal and Joint physical custody of the minor children; 24 b.
A 2/2/5 parenting time schedule, including additional parenting orders, a holiday 25 schedule; and 26 c. Guideline child support, including mandatory add-on expenses. 27 3) On December 9, 2025, Father filed a Notice of Errata to correct a minor typographical error in his 28 original declaration. 29 4) On December 29, 2025, Mother filed a Responsive Declaration wherein she requests:
1 a. Sole legal and sole physical custody; 2 b. Father’s parenting time on the 1st and 3rd weekends of each month from Thursday after 3 school through Sunday at 6:00 p.m.; 4 c. Father’s parenting time on the 2nd and 4th weeks of each month to from Wednesday after 5 school to Friday return to school; 6 d. Holiday schedule per Mother’s FL-341(C).; and 7 e. She consents to a guideline child support order. 8 5) On January 12, 2026, the Court referred the parties to FCS Mediation on February 25, 2026, and 9 set a return hearing on March 10, 2026. 10 6) On March 10, 2026, the matter was heard; however, around the same time that the Court issued 11 its tentative ruling for this hearing the parties reached an agreement.
The Court did not adopt the 12 tentative ruling at the request of the parties to permit them the opportunity to submit a stipulation. 13 At the hearing, the parties indicated they wanted a further review hearing on custody/visitation 14 issues; therefore, the Court set a review hearing for June 23, 2026. 15 7) On June 15, 2026, Mother filed a “Respondent’s Supplemental Declaration in Opposition to 16 Petitioner’s Request for Order re: Custody, Visitation and Child Support, which has been read 17 and considered by the Court. 18 8) On June 15, 2026, Father filed a “Supplemental Declaration of Bryan Beeley,” which has been 19 read and considered by the Court. 20 9) The parties did not submit a Stipulation and Order as they indicated they intended to do at hearing 21 on March 10, 2026. 22 B.
Findings and Order 23 1) This Court has jurisdiction to make child custody orders in this case under the Uniform Child 24 Custody Jurisdiction and Enforcement Act. A violation of this order may subject the party in 25 violation to civil or criminal penalties, or both. The country of habitual residence of the minor 26 child(ren) is the United States. 27 2) The parties shall share joint legal and joint physical custody of the minor children. 28 3) The parenting time shall be on a 2/2/5 schedule to commence on June 23, 2026, as follows: 29
1 a. Mother shall have care and custody of the children every Monday and Tuesday, 2 overnight. 3 b. Father shall have care and custody of the children every Wednesday and Thursday, 4 overnight. 5 c. They shall alternate weekends from Friday after school through Monday morning drop 6 off. 7 d. The exchanges shall occur at school/camp. If no school/camp is in session, the exchange 8 shall occur at 9:00 a.m. The receiving parent shall pick up the children from the other 9 parent’s home. 10 4) Either parent may travel with the children outside of California, but within the United States, as 11 long as they give the other parent 30- day notice in advance and a complete itinerary 15 days in 12 advance of the proposed travel. 13 5) For Mother’s Day and Father’s Day, the children shall be with the celebrated parent from 9:00 14 a.m. -7:00 p.m. 15 6) The Court DENIES the request for the Court to implement a holiday schedule.
The parties are 16 encouraged to work together to develop a schedule that is in the children’s best interest. 17 7) The Court finds good cause to adopt Father’s proposed child support calculations labeled 18 Attachment E and Attachment G of Father’s June 15, 2026 Supplemental Declaration. 19 8) As such, effective December 4, 2025 (i.e., the filing date of Father’s motion), Father owes Mother 20 $1,254 per month in guideline monthly child support in accordance with the XSpouse labeled 21 Attachment E (which is attached hereto and incorporated herein).
The parties shall meet and 22 confer regarding any child support arrears owed during this period. 23 9) Commencing June 23, 2026, Father owes Mother $545 per month in guideline monthly child 24 support in accordance with the XSpouse labeled Attachment G (which is attached hereto and 25 incorporated herein). Payments are due by the 1st of every month. 26 10) The parties shall share equally the following add-ons dated back to December 4, 2025: childcare 27 costs related to employment or to reasonably necessary education or training for employment 28 skills, reasonable uninsured healthcare costs and the reasonable costs associated with mutually 29 agreed upon extracurricular activities (neither party shall unreasonably withhold consent for a
1 child to participate in an activity). The procedure to make or pay a reimbursement claim for these 2 child support add-ons shall be as set forth in Judicial Council Form FL-192. 3 11) Any prior orders, not in conflict with the orders made herein, shall remain in full force and effect. 4 12) Counsel for Father shall prepare the Findings and Order After Hearing, which shall include as 5 attachments the Xspouse reports referenced herein and forms FL-342 and FL-192. 6 13) Preparation of Order: If you are directed by the court to prepare the order after hearing – within 7 10 calendar days of the hearing you must either: (a) Serve the proposed order to the other 8 party/counsel for approval, and follow the procedures set forth in CA Rules of Court, Rule 9 5.125(c), or (b) If the other party did not appear or the matter was uncontested, submit the 10 proposed order after hearing directly to the court.
Failure to submit the order after hearing within 11 10 days may allow the other party to prepare a proposed order and submit it to the court in 12 accordance with CA Rules of Court, Rule 5.125(d). 13
