PLAINTIFF 1066 MARKET LLC Motion To Deem Admitted Request For Admissions, Set One is DENIED. Plaintiff moves, based on Defendant's late responses and Defendant's failure to strictly comply with CCP 2033.220 with regard to 9 of 35 responses, to deem all 35 admissions admitted. Plaintiff cites no case law supporting this liberal application of the drastic remedy provided by CCP 2033.280.
Based on the moving papers, the Court finds that Defendant served substantially compliant responses to the Request for Admissions before this motion was filed. As substantial compliance is the standard under CCP 2033.280(c) and the responses were provided before this motion was filed, the motion is denied in its entirety. Nothing in this ruling shall prevent Plaintiff from seeking any other remedy that may be appropriate under the Civil Discovery Act.
Finally, Plaintiff is admonished to comply with CRC 2.111 in filing any future declarations of counsel by including the name and state bar number of the attorney making the declaration at the top of the first page of the filing. =(501/CFH)
