CASE NUMBER: 24CV-0205268 Tentative Ruling on Orders to Show Cause Re: Striking Answer and Cross-Complaint: On May 14, 2026, an Order to Show Cause (“OSC”) Re: Striking Answer and Cross Complaint was issued to Defendants Maximus Tree Works, LLC and Johnnie Morales (“Defendants”), in pro per for their failure to appear at the prior hearings on December 8, 2025 and May 4, 2026 and for their failure to participate in this case. No response to the OSC has been filed. Defendants have not taken any action on this case for several months.
The Court previously imposed monetary sanctions against Defendants but the sanctions remain unpaid. Additionally, imposition of monetary sanctions was insufficient to compel Defendants to participate in this case. The Court finds that the Defendants have abandoned their defense and cross-claims. The Court intends to strike Defendants’ Answer and Cross-Complaint absent an appearance by Defendants and good cause shown.
