Hearing: Motion for Attorney’s Fees

Defendant Tri-Counties Club, Inc. (TCC) filed a motion for attorney’s fees on April, 22, 2026. On April 29, 2026, Chuck Larson (Chuck) filed a Notice of Appeal of the underlying order sustaining TCC’s demurrer without leave to amend.

The parties have stipulated and on June 2, 2026, the Court has entered an order as follows:

1. The June 23, 2026 date for TCC's Motion for Attorney Fees shall be vacated pending appeal upon the conditions that: (a) Should the appeal be granted, the motion will be moot. (b) In the event Chuck's appeal is denied, the court shall then reschedule a hearing on TCC's fee motion for the first available date, providing sufficient time for Chuck to file an opposition to TCC's motion should he elect to do so. (c) In the event Chuck's appeal is denied, Chuck agrees not to appeal the court granting TCC's fee motion, except on the basis of the necessity and reasonableness of TCC's fees.

The motion for attorney’s fees is therefore taken off-calendar pursuant to the stipulation.

If the appeal is denied, TCC shall file an ex-parte application to re-set the hearing date for its motion for attorney’s fees, at which time the Court will set a date. TCC shall attach to the application a copy of this order, and a copy of the June 2, 2026 order on the parties’ stipulation.
