Procedural History 16 1. The parties are Petitioner, Randy C. Almonte Medina, and Respondent, Geraldine Ayerdis.
The 17 parties married on August 11, 2018. The parties agree their date of separation is October 4, 2022, 18 for a marriage of 4 years and 1.5 months. The parties have three minor children, Randy Bryan 19 Almonte (DOB: December 12, 2019), Rylan Anderson Almonte (DOB: June 18, 2021), and 20 Reagan Charlotte Almonte (DOB: May 17, 2025). Both parties are self-represented. 21 2. Petitioner’s Proof of Service of Summons, filed December 26, 2025, reflects that Respondent was 22 personally served with a completed and blank Schedule of Assets and Debts and a completed and 23 blank Income and Expense Declaration. 24 3.
Petitioner filed an Income and Expense Declaration on December 24, 2024 and attached a 25 Schedule of Assets and Debts to his Request for Order filed December 24, 2024. Respondent 26 filed an Income and Expense Declaration on January 13, 2026. 27 4. Petitioner filed a Request for Order seeking bifurcation of marital status on March 23, 2026, 28 without attaching Request or Response to Request for Separate Trial (Judicial Council FL-315). 29 Respondent did not file a Response to this request.

The matter is also before the Court on Petitioner’s Request for Order filed March 2, 2026, seeking 2 orders for custody, visitation, child and spousal support, property control, attorney’s fees, 3 allocation of minor children as tax dependents, and an order compelling full financial disclosure. 4 Petitioner requests that Respondent provide tax returns, bank statements, and complete income 5 information. 6 6. Respondent filed a Responsive declaration on March 27, 2026, opposing Petitioner’s requests.
As 7 to the issue of attorney’s fees, Respondent argues there is no disparity in income. As to the issue 8 of financial disclosures, Respondent asserts Petitioner has not fully complied with financial 9 disclosure requirements and requests that Petitioner provide complete financial documentation, 10 including bank statements and records of accounts in the Dominican Republic. 11 7. The issues of child and temporary spousal support and allocation of tax dependents are currently 12 set for hearing on June 16, 2026, at 8:30 a.m. in Department 414. 13 8.

Due to the parties’ dispute regarding income, the Court ordered the parties to exchange the 14 following documents: 15 a. Serve updated Income and Expense Declaration on each other and San Francisco 16 Department of Child Support Services; 17 b. Exchange 2024 and 2025 tax returns with all schedules and W2’s, and or 1099’s received 18 for said tax years; 19 c. Documentation of childcare and visitation-related travel expenses; 20 d. Petitioner to provide documentation of any interest in or rental income from a foreign 21 property; 22 e.
These documents were ordered to be exchanged two weeks prior to the June 16, 2026 23 hearing. 24 B. Findings and Order 25 1. The Court, having considered Petitioner’s request to bifurcate marital status, and good cause 26 appearing, orders Petitioner’s request to bifurcate marital status is continued to allow Petitioner to 27 perfect the motion. 28 2. Petitioner shall complete the following requirements prior to further consideration of the request: 29
1 a. File a Declaration Regarding Service of Declaration of Disclosure and Income and 2 Expense Declaration (Judicial Council Form FL-141). 3 b. Petitioner shall complete and file Request or Response for Separate Trial (Judicial 4 Council Form FL-315). 5 c. Petitioner shall join, if applicable, any pension or retirement plans to this proceeding in 6 accordance with applicable law. 7 3. Respondent’s request to claim the children as dependents for tax purposes was set by Department 8 404 in Department 414 for June 16, 2026, at 8:30 a.m. and will be heard on that date in related 9 case FCS-24-357088. 10 4.
Petitioner’s request to compel full financial disclosure as it pertains to tax returns is moot, as the 11 Court already ordered both parties to exchange their respective 2024 and 2025 tax return, 12 including all schedules, W2’s and 1099’s for both tax years. As to both parties’ request for bank 13 statements, the Court DENIES those requests and directs the parties to the ACCESS Center for 14 guidance on conducting discovery. 15 5. As to the issue of attorney’s fees and cost, the matter is continued due to the parties’ disputed 16 income.
The Court sets this issue, along with Petitioner’s request for bifurcation of marital status, 17 for hearing on June 25, 2026 at 1:30 p.m. in Department 414. 18 6. The Court will prepare the order after hearing. 19
